LLC “PAUS KONSULTS” is a licensed extrajudicial debt service provider (special permit (licence) No. PA-2022-4), which carries out extrajudicial debt recovery from debtors on behalf of itself and as an authorized person of business partners (creditors). In carrying out extrajudicial debt recovery activity, LLC “PAUS KONSULTS” fulfils the duties specified in the Law on Extrajudicial Recovery of Debt and the guidelines developed by the Consumer Rights Protection Centre. LLC “PAUS KONSULTS” respects your privacy and undertakes to maintain your right to the lawful processing and protection of your personal data. The Privacy policy of LLC “PAUS KONSULTS” is developed with the aim to provide you with understandable explanation of the use of your personal data or any other data that LLC “PAUS KONSULTS” could collect about you. Data processing legal basis in the debt collection process is a legitimate interest of creditors and fulfilment of the duties of LLC “PAUS KONSULTS”, as a Data processing manager, specified in regulatory enactments.

DATA PROCESSING OBJECTIVE AND LEGAL BASIS

LLC “PAUS KONSULTS” uses personal data to fulfil its assigned duty – to perform debt collection services, to protect its own and third parties' legitimate interests.

-perform extrajudicial debt recovery, complying with the requirements specified in the Law on Extrajudicial Recovery of Debt (for example, communicating with you);

-monitor fulfilment of payment obligations;

-check your identity;

-fulfil the legal obligations of LLC “PAUS KONSULTS” resulting from the Law on Extrajudicial Recovery of Debt, accounting and other regulatory enactments;

-use them in any other legal manner that corresponds to the relations of LLC “PAUS KONSULTS” with you;

-protect and defend the rights and legitimate interests of LLC “PAUS KONSULTS”;

-provide third parties with information about your creditworthiness.

When you use the website of LLC “PAUS KONSULTS” www.paus.lv (hereinafter referred to as the Website), LLC “PAUS KONSULTS” does not collect your personal data. With your consent, only the information provided by you is processed which is indicated when providing reports, payment orders, other documents and current contact data, as well as when asking questions. METHODS FOR DATA ACQUISITION

LLC “PAUS KONSULTS” acquires information in three ways:

-when you provide information yourself, for example, in person, by post, e-mail, telephone;

-automatically, when you use the debt history database RISK.LV;

-when information is provided by third parties, such as business partners – creditors, your authorized persons, or it is acquired from external sources (public databases). 

SCOPE OF INFORMATION

LLC “PAUS KONSULTS” processes the following data of natural persons in the process of debt recovery: Your name (surname, first name), identity number, address, e-mail address and telephone number, date of birth, employment status, employer's name, work telephone number, monthly income and expenses, any other information that a person wishes to provide.

The scope of information to be included in the debt history database RISK.LV is determined in accordance with Paragraph two of Section 13 of the Law on Extrajudicial Recovery of Debt.

DATA PROCESSING PRINCIPLES

In the processing of personal data, LLC “PAUS KONSULTS” ensures the right of every person to privacy, strictly complies with the regulatory enactments of Latvia on force, international regulations and requirement of other legal acts as well as ensures that the following principles are applied in its activities:

-personal data must be collected only for specific and lawful purposes and they must be processed only for purposes which are consistent with the specified purposes - of personal data collection;

-personal data must be processed accurately, honestly and lawfully;

-personal data must be accurate and, whenever necessary for the processing of personal data, be kept up to date. Data that are inaccurate or incomplete must be corrected, supplemented, deleted, or their processing must be terminated;

-personal data must be identical, adequate and in the scope necessary for the collection and further processing of the data;

-personal data must be kept in a form which permits the identification of the data subjects for no longer than is necessary for the purposes for which they were collected and processed.

DATA STORAGE TIME

LLC “PAUS KONSULTS” stores personal data according to the defined personal data processing objectives and requirements of regulatory enactments, while there is met at least one of the following criteria:

-LLC “PAUS KONSULTS” has a legal obligation to store the data and the storage term is specified in the regulatory enactments;

-LLC “PAUS KONSULTS” needs to realize its legitimate interests;

-debt recovery is performed;

-the consent of the data subject to the relevant processing of personal data is in force;

-data are stored in the debt history database RISK.LV in accordance with the law.

DATA TRANSFER TO THIRD PARTIES

LLC “PAUS KONSULTS” is entitled to transfer personal data to third parties, if it is provided for by provisions of the agreement concluded between LLC “PAUS KONSULTS”and the business partner (creditor) or there is another legal basis for the transfer of data. LLC “PAUS KONSULTS” is entitled to transfer your personal data, which are included in the debt history database RISK.LV, to third parties for the purpose of providing information about your creditworthiness. Personal data are not processed outside the European Union/European Economic Area (EU/EEA).

DATA SUBJECT RIGHTS

You, as a data subject, are entitled to receive confirmation from LLC “PAUS KONSULTS” that your data are or are not processed, and if they are, you are entitled to access the relevant data and receive the information provided for in the regulatory enactments.

You, as a data subject, are obliged to inform LLC “PAUS KONSULTS” of any changes to your data that you have provided during the course of the cooperation as well as if you have determined that the personal data, which are processed, are inaccurate.

If after the answer given by LLC “PAUS KONSULTS”, you believe that the performed data processing is unlawful, you are entitled to contact the supervisory authority – the Data State Inspectorate.

LLC “PAUS KONSULTS” carries out automated decision making in order to ensure compliance with the requirements for the placement of information in the debt history database RISK.LV provided for in the the Law on Extrajudicial Recovery of Debt.
